How to proceed if you have become an heir of rights after a performing artist?
According to the existing legislation, the rights of a performing artist are subject to inheritance, and as such they must be resolved in the inheritance proceedings. If you are an heir of rights, contact us. In order to claim the rights, you must submit a Decision of the Settlement and Distribution of the Decedent´s Estate which came into legal force. Such decision must contain information who became an heir of the deceased performing artist. If such document contains a decision about the inheritance of the rights after the deceased artist, the heirs register with INTERGRAM by entering into a contract of representation of inherited rights. Remuneration collected for deceased artists are remitted to such heirs on a regular basis.
The contractual relationship between a heir and INTERGRAM is created upon the conclusion of a contract of representation of inherited rights.
Documents required for the conclusion of the contract of representation of inherited rights of performing artist:
1. Contract of representation of inherited rights of performing artist
The contract of representation of rights must be filled in two copies and both copies must be sent to the INTERGRAM address. One copy signed by INTERGRAM will be then sent back to the heir. One of such two copies must bear a certified signature of the heir, or a handwritten signature of the heir + the delivery of a clearly visible colour photocopy of the heir´s valid identity card containing his/her signature must be provided. A certified signature is not required in contracts of representation which are signed on INTERGRAM´s premises. In such case, the heir signs the documents on site and his/her identity is verified by a competent employee of INTERGRAM from the identity card provided by such cardholder.
2. Instructions for consignation of remuneration from INTERGRAM
The Instructions for consignation of remuneration from INTERGRAM are intended for providing information regarding the bank, address and tax domicile. Should there be a change of the name or the bank, the Instructions form must bear the heir´s certified signature, or the heir may sign the form and send a clearly legible colour photocopy of the valid identity card containing his/her signature. After verifying the heir´s identity, the photocopy of the identity card will be shredded.
