What does INTERGRAM offer to producers of phonogram and audio-visual fixations?

Are you a producer of phonograms (recordings) or audio-visual fixations (video clips) which have been/are/will be broadcast on the radio, television or online?

As a rightholder under the Copyright Act, you are entitled to remuneration for the use of your recordings or video clips.

We provide administration of your rights in the territory of the Czech Republic and abroad under international treaties and bilateral agreements concluded with foreign collective management organizations.

I AM A PRODUCER OF AUDIO-VISUAL FIXATIONS

For the purposes of INTERGRAM, subject to the terms and conditions of the Articles of Association and pursuant to the applicable wording of the Copyright Act, a phonogram producer is a natural person or a legal entity who or which takes the initiative and has the responsibility for the first fixation of the sounds of a performance of a performer, or of other sounds, or of representation of sounds.

The contractual relationship between the producer of phonograms and INTERGRAM arises from conclusion of a contract of representation.

Documents required for the conclusion of the contract of representation of rights of the producer of phonograms:

1. Contract of representation of rights of the producer of phonograms

The contract of representation of rights must be filled in two copies and both copies must be sent to the INTERGRAM address. One copy signed by INTERGRAM will be then sent back to the producer. One of such two copies must bear a certified signature of the rightholder, or a handwritten signature of the rightholder + the delivery of a clearly visible colour photocopy of the rightholder´s valid identity card containing his/her signature must be provided. A certified signature is not required in contracts of representation which  are signed on INTERGRAM´s premises. In such case, the rightholder signs the documents on site and his/her identity is verified by a competent employee of INTERGRAM from the identity card provided by such cardholder.

If the rightholder is a legal entity, the person authorized to sign is a member of the governing body of such legal entity as indicated in the commercial register of the country. If it is indicated in the commercial register that two or more members of the governing bodies are required to sign, all such signatures must be certified.


2. Instructions for consignation of remuneration from INTERGRAM

The Instructions for consignation of remuneration from INTERGRAM are intended for providing information regarding the bank, address and tax domicile. Should there be a change of the name or the bank, the Instructions form must bear the rightholder´s certified signature, or the rightholder may sign the form and send a clearly legible colour photocopy of the valid identity card containing his/her signature. After verifying the rightholder´s identity, the photocopy of the identity card provided by the rightholder will be shredded.

The statutory declaration of a phonogram producer is submitted by a producer in order to exercise the right to remuneration pursuant to Section 76 of Act No. 121/2000 Coll., as amended (i.e. the right to remuneration for the reproduction of the copyright work for personal needs) collected in the previous year. The statutory declaration takes account of the income from the physical sales of carriers and downloading in the territory of the Czech Republic, as well as the income from on demand streaming of phonograms or audiovisual usage of phonograms in the territory of the Czech Republic.

The contractual relationship between the producer of audio-visual fixation and INTERGRAM arises from conclusion of a contract of representation.

Documents required for the conclusion of the contract of representation of rights of the producer of audio-visual fixations:

Statutory declaration of audio-visual fixations is submitted by a producer in order to exercise the right to remuneration pursuant to Section 22 (TV broadcast transmission), Section 23 (TV broadcasting activities), and Sectiion 25 (right to remuneration in connection for the reproduction of the copyright work for personal needs) of Act No. 121/2000 Coll., as amended, collected in the previous year.

Such Statutory declaration does not apply to musical audio-visual fixations, i.e. video clips. The remuneration for the producers of such fixations is calculated in accordance with the valid and effective INTERGRAM Distribution Rules on the basis of the identifiable portion of income collected for the use of such fixations in the previous year.

In connection with the development of a new distribution module for producers of audio-visual fixations, the schedule for submitting the Statutory declaration of a producer of audio-visual fixations for 2023 has been postponed.

The new schedule for this year is as follows:

  • April 2024: Publication and distribution of the call for submission of the Statutory declaration of a producer of audio-visual fixations 2023
  • June/July 2024: Deadline for submission (will be specified in the April call)
  • August 2024: Distribution and payment of remuneration to the producers

Recording Protocol

By submitting a Recording Protocol you will register your recordings both with INTERGRAM and abroad and specify the remuneration of the shares of performing artists from the particular recording being used.

The Recording Protocol is filled out by the Producers in cooperation with the Performers participating in the recordings.

The Recording Protocol is filled out for each recording (song) separately, i.e. one recording (title) equals one Recording Protocol form.

Please do not fill out the protocol in an internet browser (Chrome, Firefox, Edge, etc.), but always download it to your computer and fill it in a PDF browser (e.g. free Adobe Acrobat Reader).

You can deliver completed Recording Protocols to INTERGRAM in the following ways:

  1. Via Website for Producers
    • If the protocol has been completed by the Producer and submitted via the Website for Producers, signatures of the individual artists or the Producer are not required.
  2. Via Data Mailbox INTERGRAM (zwrm6gv)
    • If the protocol has been completed by the contractually represented Producer and submitted via the Data Mailbox, signatures of the individual artists or the Producer are not required.
  3. By email
    • We prefer submission via the Website for Producers or DM.
    • If the protocol was sent from a registered e-mail by a contractually represented Producer who granted consent to electronic communication, we accept the protocol without signatures.
    • In other cases, we require artists´ signatures.
  4. Via the Website for Performers
    • The signature of the artist logged in is not required. Signatures of other artists are still required.
  5. Physically/mail delivery
    • We prefer submission via the Website for Producers or DM.
    • If the protocol was filled out by the statutory representative of the contractually represented Producer, his/her signature is sufficient on the protocol. In other cases, signatures of all artists are still required.
